Surrogacy in Australia

While not all states within the USA legalize surrogacy, there are many states that do. Australians are not so fortunate, as most of the country, surrogacy is illegal or the laws legalizing surrogacy are so problematic and recognize the surrogate as the legal mother if there is a dispute between the couple and the surrogate, that most couples look elsewhere.

This couple found a way and her sister carried her baby for her. Surrogacy in the state where they moved to is legal as long as the surrogate is not paid a fee (altruistic). Most of the countries and states where surrogacy is illegal or is restricted to unpaid surrogacy do so because the legislators believe that paying a woman to carry a child is degrading to women and illegal baby selling under current adoption laws.

Hi Stephanie,
I'm wondering if you could make suggestions for the most inexpensive means of surrogacy. I'm familiar with the options in India (just from Oprah's show) but I don't know what other national or international options there might be.

Thanks very much.

A friend or family member is usually the the most inexpensive way to have a child via surrogacy. You don't have to pay an agency, and for the most part, a trusted member carries your child. I knew my surrogate and paid her a fee, but the fee was less than the going rate for a first-time surrogate. Please let me know if you have any other questions.

Hi Stephanie,

We are considering using the surrogacy program in India. If successful do you see us having a legal issue bringing our child into Australia?

I would check with a family law attorney experienced in surrogacy in your country regarding the legal issues of bringing a child home to Australia. Please let me know if you have any other questions or concerns. Thank you.

Hi Steph,
im a student currently sitting my Higher School Certificate (year 12 in Australia)
As one of my subject requirements, I had to come up with a top for my 'Personal Interest Project' which in this cause is on Surrogacy.
I was wondering if I you would kindly spare some time and complete a interview sheet (via email) as this would be highly valuable towards my studies. Please don't feel pressured into this but it would be greatly appreciative.
Thank you for your time.
